WORK PROCEDURE FOR SELECTION OF PROVIDERS OF COLLECTION, PROCESSING AND RECYCLING SERVICES

Introduction

This procedure governs the selection, collaboration, and monitoring of operators involved in the management of waste electrical and electronic equipment, in order to ensure compliance with the applicable environmental regulations and to maintain a transparent and efficient process flow.

This procedure regulates the collection, transport, storage, processing, recycling, and recovery of waste electrical and electronic equipment (WEEE) carried out in collaboration with the collective organization ECOTRON SA. It is intended to ensure compliance with the current regulations and to maintain a transparent and efficient management flow for environmental protection.

Purpose

This procedure is intended:

  • To ensure the WEEE traceability along the entire logistics chain;
  • To comply with the legal requirements in terms of reporting, collecting, processing and recovery of WEEE;
  • To select and assess the providers for WEEE transport, collection and recycling services in line with the requirements applied by ECOTRON SA and the relevant laws.

Definitions

  • PRO (Producer’s Responsibility Organization):a licensed legal entity which takes over the producers’ responsibility in terms of achieving the WEEE collection, recycling and recovering targets;
  • EEE: Electric and Electronic Equipment that are electricity-based or electromagnetic field-based;
  • DEEE: Waste of Electric and Electronic Equipment which have been decommissioned;
  • Collection: the operation whereby WEEE are taken over from the entities generating them;
  • Transport: the transport of WEEE towards the installations, according to the provisions of Government Decision 1061/2008;
  • Processing: manual or mechanical dismantling and/or neutralization;
  • Recycling: the process whereby WEEE are turned in secondary raw materials;
  • Recovery: the use of WEEE for energy or material purposes.

Governing Law

  • Government Emergency Ordinance No 196/2005 on the Fund for Environment;
  • Government Decision No 856/2002 on waste management records;
  • Government Decision No 1061/2008 on waste transport;
  • Order No 269/2019 on reporting in SIATD and in the Producers’ Registrar.

Profile of Partner Operators

  • Valid and updated environmental permit;
  • Annual visa applied by APM (Environmental Protection Agency);
  • Registering with and reporting to SIATD;
  • Reporting in the AFM application (collection, processing/recycling);
  • Traceability documents (protocols of delivery, lists of materials/equipment, inventory lists);
  • Verifiable operational capacity (warehouses, equipment, personnel).

Procedure for WEEE Collection

Collection-related requirements:

  • WEEE from permitted locations;
  • WEEE sorting by minimum 6 categories, including dangerous/safe separate selection;
  • Detailed records (kg., pieces).

Temporary storage:

  • Temporary storage, by 6 categories, separate storage of dangerous/safe WEEE, according to GEO No 5/2015;
  • Delimited, water proof, protected area;
  • Cover with tarpaulin, plastic sheet etc.

Records and documents:

  • Records broken down by types of waste, kg and pieces;
  • Documents made available to ECOTRON SA and authorities;
  • Reporting according to Order No 269/2019.

Procedure for WEEE Transport

  • Licensed transport;
  • Annexes and transport documents are prepared in line with GD No 1061/2008;
  • Packing and labeling as per the legal requirements.

Procedure for WEEE processing and recycling

WEEE is processed either in licensed installations or manually, depending on the method laid down in the provider’s environmental permit, in line with the standards applicable in the industry, i.e. Order No 417/2021 on the processing of WEEE.

This action is intended to decontaminate, dismantle and separate components for further recovery or safe disposal and/or recovery of reusable materials.

The recycling operator must have in place clear and written procedures, accessible to all employees, for each activity flow related to the processing and recycling of WEEE.

The recycling operator shall provide ECOTRON SA with the Processing Register/Processing Report, recovery/disposal certificates, or any type of document recording the WEEE processing/recovery process.

The recycling operator undertakes to provide ECOTRON SA, whenever requested, with the possibility to prepare reference batches of WEEE, required for reporting, audits, or internal/external inspections.

The minimum recycling and recovery ratio in accordance with Article 8 of Government Emergency Ordinance No 5/2015 are presented below:

Disclaimer: The obligation to achieve these minimum recycling and recovery ratios falls on the provider selected by ECOTRON SA, according to the recycling agreements signed by the parties.

Conditions to Disqualify the WEEE Providers

The providers of WEEE collection, transport, processing and recycling services may be disqualified from the selection or may cease to be partners of ECOTRON SA in the following events:

They fail to provide/hold the mandatory documents:

  • Absence of a valid environmental permit;
  • Absence of the annual visa issued by the Environmental Protection Agency;
  • Failure to report to the legal platforms (SIATD, AFM).

Inconsistencies in the activity carried out:

  • Impossibility to demonstrate waste traceability;
  • Mis-reporting or incomplete reporting to the authorities;
  • Failure to provide records when requested by ECOTRON SA or the competent authorities.

Failure to achieve the minimum performance indicators:

  • Repeated failure to achieve the minimum recycling and recovery ratios according to Government Emergency Ordinance No 5/2015 (Article 8), for more than two (2) consecutive trimesters;
  • Frequently exceeding the reporting or collection timelines provide for in the contract

Breach of legislation or contractual terms and conditions:

  • Using illegal or undeclared practices in terms of handling, storage or disposal of WEEE;
  • Any major sanction is applied or any temporary suspension of the provider’s activity is ordered by the authorities;
  • The provider breaches the terms and conditions of the ongoing contract with ECOTRON SA.

Unacceptable commercial or professional conduct:

  • Unreasoned refusal to provide documents or access for inspection/audit;
  • Bad attitude towards ECOTRON SA’s team or other parties involved in the logistics chain

Disqualification may be temporary (with a period for remedy allowed) or permanent, depending on how severe the beach is, based on a decision made by the management team of ECOTRON SA.
